Terms and Conditions

1. Acceptance of Terms
Welcome to Tomafly. These Terms of Service (“Terms”) govern your access to and use of the website tomafly.com and the services operated by TOMAFLY LLC (“Tomafly”, “we”, “us”, or “our”). By accessing or using our platform, placing an order, or registering as a pilot, you agree to be bound by these Terms. If you do not agree, please do not use our services. We may update these Terms from time to time, and your continued use after changes are posted constitutes acceptance of the revised Terms.
2. About Tomafly
Tomafly is a technology platform that connects clients who need aerial imaging with independent, FAA Part 107 certified drone pilots across the United States. Through our platform, clients can request aerial photography, video, inspections, mapping, and related services, and we match each request with a qualified pilot near the requested location.
Tomafly acts as an intermediary that facilitates these connections. The pilots who fulfill orders are independent contractors and are not employees or agents of Tomafly.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a legally binding contract to use our services. When you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
4. The Role of the Platform
Tomafly provides the platform that connects clients and pilots. While we vet pilots for FAA Part 107 certification, we do not directly perform the aerial operations and do not guarantee any specific result, artistic outcome, or availability. Any agreement for services is formed between the client and the assigned pilot, facilitated by Tomafly. We are not a party to that service relationship except as expressly stated in these Terms.
5. Orders and Bookings
To request a service, clients submit an order specifying the service type, location, date, and any special requirements. An order is confirmed only once Tomafly accepts it, a pilot is assigned, and any required payment or deposit is received. Quotes provided are estimates and are valid for 30 days unless otherwise stated.
6. Pilot Requirements and Obligations
Pilots who register with Tomafly represent and warrant that they:
- Hold a valid FAA Part 107 Remote Pilot Certificate;
- Operate properly registered and airworthy equipment;
- Maintain appropriate liability insurance;
- Comply with all federal, state, and local laws and FAA regulations; and
- Will perform each assignment in a professional, workmanlike manner consistent with industry standards.
7. Pricing and Payments
Pricing is presented at the time of booking and may vary based on service type, location, duration, and deliverables. Payment is processed through our authorized third-party payment providers. Unless otherwise agreed, full payment is due upon booking confirmation. Deliverables may be withheld until payment is received in full. Late amounts may incur reasonable charges as permitted by law.
8. Cancellations, Rescheduling, and Weather
Drone operations depend on weather and airspace conditions. We reserve the right to postpone or reschedule a flight for safety, weather, or regulatory reasons at no penalty to the client. Client-initiated cancellations are subject to the following, unless otherwise stated at booking:
- More than 48 hours before the scheduled service: full refund of any deposit;
- Within 48 hours: up to 50% of the service fee may be charged;
- Same-day cancellations or no-access on site: up to the full service fee may be charged.
9. Deliverables, Licensing, and Intellectual Property
Upon full payment, clients receive a license to use the deliverables (photos, video, models, and reports) for the business purpose described in the order. Unless otherwise agreed in writing, Tomafly and/or the assigned pilot retain copyright in the original works. We may use non-confidential project deliverables for marketing and portfolio purposes; if confidentiality is required, the client must notify us in writing before the service begins.
10. Client Responsibilities
Clients are responsible for obtaining all necessary permissions and property access rights for the requested operations, providing accurate site information (including hazards and restrictions), ensuring the site is safe for drone operations, and complying with all applicable laws. Clients must promptly inform us of any change that may affect safety or feasibility.
11. FAA Compliance and Airspace
All flights are conducted under FAA Part 107 by certified remote pilots. Certain locations may be restricted or require waivers, and some requests may not be possible due to airspace, security, or regulatory limitations. We will inform clients when such limitations apply.
12. Prohibited Uses
You agree not to use our platform for any unlawful purpose, to request operations that violate privacy or property rights, to interfere with the platform’s operation, or to misrepresent your identity or authority. We may suspend or terminate accounts that violate these Terms.
13. Disclaimers and Limitation of Liability
Our platform and services are provided “as is” and “as available.” To the fullest extent permitted by law, Tomafly disclaims all warranties not expressly stated herein. Tomafly shall not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim. We are not responsible for the independent acts or omissions of pilots beyond our facilitation role.
14. Indemnification
You agree to indemnify and hold harmless TOMAFLY LLC, its officers, and affiliates from any claims, damages, or expenses arising from: (a) your failure to obtain necessary permissions or access rights; (b) inaccurate information you provide; (c) your use of deliverables in violation of law; or (d) your breach of these Terms.
15. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
16. Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including weather, acts of God, government or airspace restrictions, equipment failure, or other force majeure events.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising from these Terms or our services shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, or through the courts located in Florida.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with any order or service agreement, constitute the entire agreement between you and Tomafly regarding our services.
